Alarming NY Memo Shows How Woke Prosecutors Are Enacting BLM’s Agenda Against Americans’ Will

Alvin Bragg, Manhattan’s new district attorney, said Monday that he will downgrade felony charges for various crimes and only seek prison time for murders and a few other types of violent criminals.


In big U.S. cities, progressive prosecutors are enacting Black Lives Matter-style criminal justice reforms that were rejected by voters.


Bragg laid out the permissive guidelines in his first memo to staff, days after he was sworn in Jan. 1 along with New York City Mayor Eric Adams, a fellow Democrat who won election on a promise to end the national violent crime surge in the city.

According to the memo, Bragg’s office will “not seek carceral sentence other than for homicide” or “class B violent felony in which a deadly weapon causes serious injury, domestic violence felonies” with few exceptions.

  • Bragg ordered his prosecutors to downgrade felony charges in cases such as armed robberies and drug dealing.
  • He also decreed the “decriminalization/non prosecution” of crimes including marijuana possession, turnstile jumping, trespassing, resisting arrest, interfering with an arrest and prostitution.

“These policy changes not only will, in and of themselves, make us safer; they also will free up prosecutorial resources to focus on violent crime,” Bragg wrote in an accompanying letter.


Bragg’s memo spurred backlash Tuesday from conservative commentators and local law enforcement officials, who warned the policy changes would further compromise public safety.

  • “Police officers don’t want to be sent out to enforce laws that the district attorneys won’t prosecute,” said Patrick Lynch, the head of the Police Benevolent Association, the NYPD’s biggest union.
  • “And there are already too many people who believe that they can commit crimes, resist arrest, interfere with police officers and face zero consequences.”

Mayor Adams, a former NYPD captain, claimed to be unfamiliar with the details of Bragg’s agenda, but said, “I have a lot of respect for DA Bragg, a former prosecutor. He has a real vision.”

  • “We can have the justice we deserve with the public safety we need,” he added.


The “defund the police” movement, spearheaded by the 2020 Black Lives Matter protests, has been largely abandoned in the face of public opposition, including by many of the black and Latino Americans it claimed to represent.

  • But the “progressive prosecutor project” has continued to enact some of the left’s most radical criminal justice reforms by executive fiat, without any need to change laws or replace judges deemed too tough on crime.

Andy McCarthy wrote last year in Commentary magazine: “The agenda here is to obstruct prosecution itself. It is, to quote Chesa Boudin, the newly elected [San Francisco district attorney], “ a movement … rejecting the notion that, to be free, we must cage others.”

  • “The key to understanding the Machiavellian brilliance of the Progressive Prosecutor Project is this: As a matter of constitutional law, no legislature or court has the power to order a prosecutor to charge any crime against any person,” continued McCarthy, a National Review writer and former assistant U.S. attorney for the Southern District of New York.
  • “Realizing this, the left’s social-justice warriors have grasped that the control of prosecutorial power may be the most effective route to rapid societal transformation. It is transformation driven not by law, logic or a half-century’s empirical data on offense behavior and policing methods, but by cultural Marxist narratives.”

In recent years, progressive activists and donors have invested heavily in district attorney races, which have traditionally been relatively low-turnout and uncompetitive, with the Democratic nominee running unopposed in most major cities.

  • “This creates an opportunity, and the [billionaire investor George] Soros network has pounced, overwhelming the field by pouring millions of dollars into the coffers of favored candidates,” McCarthy wrote.
  • Woke prosecutors also reign in Wisconsin, Chicago, San Francisco, Los Angeles, Philadelphia, Seattle and Portland — “wherever the Democratic left controls politics, it continues. And the politics is often protected by willing media that gaslights the public,” Chicago-based columnist John Kass wrote on his blog last month.

Even as McCarthy and Kass mourned the bloody toll of liberal urban governance, they also pointed to signs of growing backlash against the progressive prosecutor movement.

  • In crime-infested San Francisco, Kass noted, Boudin is “facing a recall election and a revolt among assistant prosecutors in his office for his soft handling of crime that has turned the streets of San Francisco into a medieval snake-pit.”
  • San Francisco Mayor London Breed, an erstwhile “defund the police” advocate, last month announced a crackdown on crime and “the bullsh*t that has destroyed our city.”
